A couple things wrong with that:

This was a criminal case between two users, whereas breach of contract is a civil one between the corporation and the user. That verdict only really holds up in two circuits, and he was still found guilty of a misdemeanor violation of the CFAA.

Myspace could have easily gone for a civil suit claiming that he damaged the community that they rely on for their profit (which they agreed not to do when they agreed to the terms of service), and sought money for some projected loss of users caused by trolls, but they didn't.

That isn't how it works as it's up to the company providing the ToS to file the suite, not another user.

What you're saying would be like going to a bank and stealing somebody's money they were going to use on a loan and then trying to sue that person for breaching the terms of the loan.

Just because somebody defaulted on a contract through actions against you doesn't mean you're entitled to anything.
